Formal consultation on the review of private building certifier insurance is under way.
PricewaterhouseCoopers have completed a report on the existing insurance scheme that identifies the range of options available to address recent insurance issues.
The BIA invites submissions from building certifiers, territorial authorities, the insurance industry, consumers and others on the issues raised in the report.
Background information and copies of the report were sent to industry stakeholders on 20 July. If you did not receive this information and wish to make a submission, the relevant documents may be downloaded from Consulting on.
The deadline for written submissions has been extended three weeks to 3 September 2004.
It is expected that building certifiers in particular may wish to present an oral as well as, or instead of, a written submission. It would be appreciated if those who require presentation of an oral submission could notify the BIA no later than 20 August so that suitable arrangements can be made. Venues and timings will be advised once the Authority receives an indication as to the number and location of applicants.
It is expected that oral submissions will be completed by 10 September or earlier, depending on the number of submissions.

Background
The Authority is responsible for the approval of building certifiers under the Building Act 1991. Before approving a building certifier, section 52(6)(c) of the Act requires the Authority to be satisfied:
That a scheme of insurance approved by the Authority will apply in respect of any insurable civil liability of the [building certifier] that might arise out of the issuing by the [building certifier] of a code compliance certificate under section 43 of this Act or a building certificate under section 56 of this Act.
The current scheme of insurance approved by the Authority is the 'Performance Specification for Insurance Cover for Building Certifiers'. A copy of this specification is available with the consultation information on the BIA website.
