My project was consented after 31 March 2005. When do I have to apply for a CCC?
Building owners whose projects received a building consent after 31 March 2005 must apply for a code compliance certificate as soon as the building work is complete. If an owner does not apply within 2 years after receiving the consent, the building consent authority will follow up on the project and decide whether to issue a code compliance certificate (unless agreed otherwise with the building consent authority). Projects under the 1991 Building Act (consented prior to 31 March 2005) will not be subject to this two-year timeframe.

If you began a building project under the old Building Act (1991) and your building consent was issued prior to 31 March 2005, then special transitional provisions will apply when you come to get the work signed off at the end of the project. You should apply for a code compliance certificate as soon as possible after completing the building work.
I obtained my building consent before 31 March 2005. What standard will the council check the building work against for a code compliance certificate when the work is complete?
For building projects consented under the 1991 Act, the building work will be assessed against the Building Code in place when the building consent was issued. This is different from the 2004 Act's provisions where work will be measured against the building consent. Under the 2004 Act, code compliance certificates will be issued against the consent. The intention of the Act is to make the compliance system fairer by addressing the problem that building work which may have started several years ago must comply with the Building Code in place today. The intention is that if the building work complies with the Building Code that was in place when you obtained your building consent then this will satisfy the requirements of a code compliance certificate.
